PROMOTION DESCRIPTION: The Empowering Latinas Stipend Promotion (“Stipend Promotion”) is open between 12:01 AM Eastern Time (“ET”) on March 1, 2022 and 11:59 PM ET on April 30, 2022 (the “Stipend Promotion Period”). The stipend will be awarded to the entrants with the highest score for the essays and/or presentations submitted, as determined in the sole discretion of Century 21 Real Estate LLC (“Sponsor”), at the conclusion of the Stipend Promotion Period. Entry into the Stipend Promotion does not constitute entry into any other promotion, contest or sweepstakes conducted by Sponsor. By participating in the Stipend Promotion, each entrant unconditionally accepts and agrees to comply with and be bound by these Stipend Promotion Official Rules (the “Official Rules”) and the decisions of the Sponsor, whose decisions shall be final and legally binding in all respects.
1. ELIGIBILITY: The Stipend Promotion is a contest open to women of Hispanic descent who: i) completed High School or GED; ii) are legal residents of the 50 United States and the District of Columbia, except Iowa; and iii) are 18 years of age or older at the time of entry (“Entrants”). Eligibility is subject to all federal, state, and local laws and regulations. Void where prohibited. Not offered in Iowa.
The Stipend Promotion is not available to any employees of Sponsor or any other organization affiliated with the sponsorship, fulfillment, administration, advertisement, or promotion of the Stipend Promotion and/or their respective franchisees, affiliated agents, affiliates, subsidiaries, and immediate family or household members of the Sponsor. Immediate family members (regardless of where they reside) or household members, whether related or not related, are not eligible to enter or win. "Immediate family members" shall mean spouses, parents, step-parents, children, step-children, siblings, step-siblings, and their respective spouses. "Household members" shall mean people who share the same residence at least three months a year.
2. HOW TO ENTER: During the Stipend Promotion Period, the Entrants will complete an application, that captures eligibility criteria and requires submission of 5 (five) initial short essays (up to 250 words) at www.c21empoweringlatinas.com. As Entrant progresses through the process, additional requirements must be satisfied.
3. LIMIT: One (1) entry per person. Any attempt to establish more than one account by using multiple/different email addresses, identities, registrations, logins, or any other methods may result in disqualification by Sponsor, in its sole discretion, and the associated points will be void. In the event of a dispute over the identity of an Entrant, the authorized account holder of the email address used to create the account will be deemed to be the Entrant and she must comply with these Official Rules. “Authorized account holder” is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
4. WINNER DETERMINATION/ STIPEND: After the Stipend Promotion Period, Sponsor will select eligible applications, using a multi-step process:
The first step will utilize the PowerAutomate program to electronically evaluate the Entrants’ initial short essays submitted with their applications based on the keywords in English and Spanish that Sponsor will provide to the programmers.
For the second step, the Sponsor will assign 10 (ten) judges to evaluate Entrants’ initial short essays submitted based on 4 (four) categories as determined in each judge’s sole discretion:
- Connection: interest in the real estate industry; portrayal of passion
- Presentation: properly addressing/ answering questions
- Organization: easy to follow; includes introduction, conclusion and sequence
- Conception: understanding real estate industry and impact of a real estate agent
Each judge will assign points to each category on the scale from 10 to 25. The highest number of points available for the essays is 1,000. On or about May 18, 2022, the Sponsor will contact the Entrants, who scored in the top 10%, to proceed to the next phase.
The third step will require the chosen Entrants to answer 2 (two) additional questions by writing an essay or creating a video or a PowerPoint presentation, which must be submitted on or before June 1, 2022. The same 10 (ten) judges will evaluate Entrants’ answers based on 4 (four) categories as determined in each judge’s sole discretion:
- Connection: interest in the real estate industry; portrayal of passion
- Presentation: properly addressing/ answering questions
- Organization: easy to follow; includes introduction, conclusion and sequence
- Conception: understanding real estate industry and impact of a real estate agent
Each judge will assign points to each category on the scale from 10 to 25. The highest number of points available for the essays is 1,000. The top 121 Entrants will be awarded the stipend (“Stipend”).
There are 121 (one hundred twenty-one) Stipends available to be awarded solely to be used for the following:
Pre-paid Real Estate pre-licensing education course by a third-party provider, The CE Shop or comparable provider, depending on the state. Sponsor will provide a list of the approved third-party providers/ educational institutions and a promotion code that must be used within 6 months. Retail value varies and is estimated between $179.00 and $1,059.00.
All Winners. All winners are responsible for all federal, state and local taxes as well as any costs and expenses associated with acceptance of the Stipend and use not specified herein as being provided. Stipend is awarded “as is” with no warranty or guarantee, either express or implied. Winners may not substitute, assign or transfer the Stipend or redeem it for cash. Sponsor reserves the right in its sole discretion to substitute the course for which the Stipend is granted (or portion thereof) of comparable or greater value for any reason. All Stipend details are at Sponsor’s sole discretion.
5. WINNER NOTIFICATION: Potential winners will be announced on June 21, 2022 and will be notified by phone and/or by email, whichever is deemed appropriate by Sponsor, using the contact information provided at the time of entry. Except where prohibited by law, a potential winner will be required to complete and return an Affidavit of Eligibility, and Release of Liability/Publicity within ten (10) days of date of notification. Please be advised that a potential winner will forfeit her Stipend and a runner-up may be selected by Sponsor in any of the following circumstances: i) if, despite reasonable efforts, any potential winner does not respond within 5 days of the first notification attempt; ii) if the notification is returned as unclaimed or undeliverable; iii) a potential winner does not return all required documents within the specified time period; or iv) the potential winner is not in compliance with these Official Rules or is otherwise determined to be ineligible. Sponsor shall have no liability for any potential winning notification that is lost, intercepted, or not received by any potential winner for any reason.
6. LIMITATION OF LIABILITY AND RELEASE: By participating in this Stipend Promotion, Entrants agree to release and hold harmless Sponsor and any other organizations affiliated with the sponsorship, fulfillment, administration, advertisement or promotion of the Stipend Promotion and the third-party educational course for which the Stipend shall be issued and each of their respective parents, agents, affiliates, subsidiaries, franchisees, website providers, webmasters, advertising and promotion agencies, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all liability, claims, litigation, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from Entrant’s participation in this Stipend Promotion and/or her acceptance, use or misuse of the Stipend, or any portion thereof (including any injury or harm relating to use of the vehicle or any travel or other activity related thereto).
Winners acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the performance, safety, quality, availability or otherwise of the Stipend Promotion or the third-party educational course offered or received or otherwise relating to the fulfillment of conditions related to the Stipend.
7. PUBLICITY RELEASE: Except where prohibited by law, acceptance of any Stipend constitutes winner’s permission for the Released Parties and their respective designees to use winner’s name, hometown (city and state), likeness, voice, statements and other personally identifiable information, for promotional, advertising and marketing purposes in any media worldwide, without additional consideration, consent, approval or review, or on a winner’s list, if applicable.
8. PRIVACY: Information submitted by Entrants is subject to Sponsor’s privacy policy at https://www.century21.com/about-us/legal/privacy. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, PLEASE DO NOT ENTER THIS STIPEND PROMOTION.
9. GENERAL TERMS: The Stipend Promotion is governed by the laws of the United States. Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, undelivered, garbled or misdirected points, registrations, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Stipend Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Stipend Promotion, the announcement of the stipends, the functionality of the Mobile App, the tabulating of points or in any Stipend Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Stipend Promotion. Released Parties are not responsible for injury or damage to Entrants’ or to any other person’s computer related to or resulting from participating in this Stipend Promotion or downloading materials from or use of the website. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this Stipend Promotion if the Stipend Promotion is compromised by virus, technical corruption, non-authorized human intervention, or any other causes which, in the sole discretion of the Sponsor, corrupt or affect the administration, security, fairness, proper play or integrity of the Stipend Promotion. Sponsor reserves the right in its sole discretion to disqualify any individual it believes has tampered with the entry process, the operation of the website or otherwise attempted to undermine the legitimate operation of the Stipend Promotion. In the event of cancellation or termination, Sponsor reserves the right to select the potential winners using all eligible, non-suspect points received prior to date of cancellation or termination or as otherwise deemed fair and appropriate by Sponsor. ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS STIPEND PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING ANY CRIMINAL PROSECUTION.
10. GOVERNING LAW/DISPUTES: To the fullest extent permitted by law, Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Stipend Promotion or any Stipend awarded shall be resolved individually, without resort to any form of class action, exclusively in the U.S. state or federal courts in or having appropriate venue for the County of Morris, the State of New Jersey and Entrant consents to the personal and exclusive jurisdiction of said courts and expressly waives any right of change of venue, forum non conveniens or any like right; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Stipend Promotion but in no event attorney’s fees; and (3) under no circumstances will Entrant be permitted to obtain damages for, and Entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and waives any and all rights to have damages multiplied or otherwise increased. In any such dispute/claim/cause of action, the court shall apply the laws of the State of New Jersey with the sole exception of New Jersey law governing choice of law/conflict of laws.
